Terms of Service

By accessing or purchasing from FAIRSHOP (fairshop.ca), you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not use the platform. These terms apply to all visitors, buyers, and any other users of the site.

FAIRSHOP is operated from Montréal, Québec, Canada and is subject to the applicable laws of the Province of Québec and the Government of Canada, including the Consumer Protection Act (L.R.Q., c. P-40.1).

FAIRSHOP ships within Canada only. By placing an order, you confirm that your shipping address is located within Canada. Orders with addresses outside Canada will not be fulfilled and will be cancelled and refunded.

You must be at least 18 years of age, or the age of majority in your province, to make a purchase.

All prices are listed in Canadian dollars (CAD) and include the item price plus applicable shipping cost. Payment is accepted via PayPal and Interac e-Transfer.

An order is confirmed once payment has been received and verified. FAIRSHOP reserves the right to cancel any order at its discretion — for example, in the event of a pricing error, stock discrepancy, or suspected fraud — and will issue a full refund in such cases.

Orders are typically processed and shipped within 1–2 business days of confirmed payment. Delivery times vary by carrier and destination and are not guaranteed once the package leaves our hands.

  • Tracking information will be provided where available.
  • FAIRSHOP is not responsible for carrier delays, lost packages after handoff, or customs-related issues.
  • Business days exclude weekends and Québec statutory holidays.

Returns are accepted within 30 days of the delivery date. To initiate a return, you must contact us before sending anything back. Items must be returned in their original condition, unused and unaltered.

Return shipping costs are the responsibility of the buyer unless FAIRSHOP is able to provide a prepaid return label at its discretion. This applies to all sales, including those where outbound shipping was provided free of charge.

Once the returned item is received and inspected, a refund will be issued to the original payment method within a reasonable timeframe. We reserve the right to refuse a return if the item is returned damaged, used, or outside the return window.

FAIRSHOP does not take chargebacks or fraudulent payment disputes lightly. Before initiating any payment dispute with your bank, card issuer, or payment provider, you are required to contact us directly so we can resolve the issue in good faith.

Unauthorized chargebacks — particularly those filed for orders that were legitimately fulfilled — may result in:

  • Permanent ban from the FAIRSHOP platform.
  • Reporting to relevant consumer fraud databases.
  • Pursuit of recovery through applicable legal channels under Québec and Canadian law.

If you believe there is an error with your order or payment, please reach out to us first. We are committed to resolving issues fairly and promptly.

You agree not to use FAIRSHOP for any unlawful purpose or in a way that violates these terms. Prohibited conduct includes but is not limited to:

  • Providing false or misleading personal or shipping information.
  • Attempting to circumvent verification or payment systems.
  • Using the platform to engage in any form of fraud or deception.

To the fullest extent permitted by applicable law, FAIRSHOP shall not be liable for any indirect, incidental, special, or consequential damages arising from the use — or inability to use — any product or service purchased through the platform.

Our total liability in connection with any order shall not exceed the amount paid by the buyer for that specific order.

FAIRSHOP collects minimal personal information (email address, shipping address, phone number) solely for the purpose of processing and fulfilling your order. We do not sell, share, or distribute your personal information to third parties, except as required to complete your order (e.g., shipping carriers).

By using FAIRSHOP, you consent to the collection and use of your information as described above, in accordance with Québec's Act respecting the protection of personal information in the private sector (Law 25).

FAIRSHOP reserves the right to update or modify these Terms of Service at any time without prior notice. Changes will be effective immediately upon posting to this page. Continued use of the platform after any changes constitutes your acceptance of the revised terms. We recommend reviewing this page periodically.
