Acceptance of Terms
By accessing or using the Fairshop website (the "Site") or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions in their entirety. If you do not agree with any part of these terms, you must not use the Site or place an order.
Your continued use of the Site following any modification to these Terms constitutes acceptance of those modifications. We recommend reviewing this page periodically.
Definitions
As used throughout these Terms, the following definitions apply:

| "Canada Post" | Canada Post Corporation, the sole carrier used by Fairshop for all shipments. |
| "Interac e-Transfer" | An electronic payment service offered by Interac Corp. and Canadian financial institutions. |
| "CAD" | Canadian dollars — the sole currency used on the Site. |
Eligibility & Verification
To place an order on Fairshop, you must:
- Be at least 18 years of age, or the age of majority in your province or territory of residence, whichever is greater.
- Provide a valid, working email address that you own and control, which will be verified via a one-time code before any purchase is permitted.
- Provide a complete and accurate Canadian mailing address — including street address, city, province, and postal code — to which your order can be delivered.
- Reside in, and accept delivery to an address within, Canada. We do not ship internationally under any circumstances.
Fairshop reserves the right to refuse, suspend, or permanently ban any account or email address at our sole discretion, including where we suspect fraud, abuse, chargebacks, or violation of these Terms.
Products & Listings
All products listed on the Site are physical goods that will be shipped to you by mail via Canada Post. We do not offer digital downloads, in-person pickup, or any other delivery method.
- Product descriptions, images, condition grades, and rarity classifications are provided in good faith and are as accurate as we can make them. Minor discrepancies between photographs and the physical item may occur due to lighting and screen calibration.
- Stock levels are displayed in real time. Listing a product does not constitute a binding offer; a contract of sale is only formed when we confirm your order and payment has been received or an Interac e-Transfer request has been issued.
- In the event that a listed item becomes unavailable after your order is placed (e.g., due to a concurrent purchase or inventory error), we will notify you promptly and issue a full refund.
- Condition grades (Mint, Near Mint, Lightly Played, etc.) follow widely accepted trading card grading conventions. Grades are assigned by us and are subjective; we do not guarantee third-party grading equivalence.
Pricing & Currency
All prices are displayed and charged in Canadian Dollars (CAD). Prices are inclusive of any applicable seller fees but do not include applicable taxes unless explicitly stated.
- The postage cost shown on each listing is the Canada Post shipping fee we charge for that item. Where postage is listed as "Free," we absorb the shipping cost.
- The Total CAD figure shown on each listing is the amount you will be charged — it is the sum of the item price and the listed postage cost.
- Prices are subject to change at any time without notice. The price at the time you place your order is the price you will pay.
- We are not responsible for currency conversion fees or foreign transaction fees charged by your bank or payment provider.
Payment Methods
Fairshop accepts the following payment methods only:
- PayPal — processed through PayPal's secure checkout. PayPal's own terms and conditions govern that transaction. Fairshop is not responsible for disputes arising within the PayPal platform.
- Interac e-Transfer — available to holders of Canadian bank accounts that support Interac e-Transfer. Upon placing an Interac order, a payment request will be sent to your verified email address. Payment must be completed within 48 hours; failure to pay within this window may result in order cancellation.
We do not accept cash, cheques, money orders, cryptocurrency, or any other payment method not listed above.
Order Process
The order process on Fairshop works as follows:
- Step 1 — Browse: Products are viewable by any visitor. Pricing and stock are displayed on each listing.
- Step 2 — Verify: You must verify your email address via a one-time code before purchasing. You must also have a complete Canadian mailing address on file.
- Step 3 — Place Order: Select your payment method (PayPal or Interac e-Transfer) and confirm your order. For Interac orders, a confirmation dialog is presented before the order is created.
- Step 4 — Payment: Complete payment via your chosen method. Stock is reserved while an Interac order is pending, but only one pending Interac order is permitted at a time per account.
- Step 5 — Fulfillment: Once payment is confirmed, we pack and mail your item via Canada Post from Montréal, Québec.
- Step 6 — Status Updates: Order status updates are available in My Orders. A tracking number will be provided where the Canada Post service used includes tracking; not all mail services offer tracking.
A contract of sale is formed only when we have confirmed receipt of full payment and dispatched your item. Prior to dispatch, we reserve the right to cancel an order due to stock discrepancies, suspected fraud, or payment failure — with a full refund issued in such cases.
Shipping & Delivery
All orders are shipped exclusively via Canada Post from our location in Montréal, Québec, Canada. We do not offer courier, express, or in-person pickup options.
- Domestic only: We ship to any valid Canadian mailing address — all ten provinces and three territories. We do not ship to P.O. boxes or addresses outside of Canada.
- Processing time: Orders are typically packed and submitted to Canada Post within 1–3 business days of confirmed payment, excluding weekends and Canadian public holidays.
- Transit time: Canada Post delivery timelines vary by destination. Typical transit from Montréal is 2–5 business days for major urban centres and 5–14 business days for remote or rural addresses. These are estimates only and are not guaranteed by Fairshop.
- Postage cost: The postage amount shown on each product listing is the amount we charge. We do not mark up postage beyond what Canada Post charges us.
- Packaging: Items are packaged at our discretion to provide reasonable protection during transit. We use appropriate protective materials for collectible items (e.g., card sleeves, toploaders, bubble mailers).
- Address accuracy: It is your responsibility to ensure your mailing address is complete and correct. Fairshop is not liable for non-delivery caused by an incorrect or incomplete address provided by you.
Lost & Damaged Mail
While we take care to package all items securely, once an item is in the possession of Canada Post, its handling is entirely outside our control.
- Lost mail: If your order does not arrive within 21 calendar days of the mailed date shown in My Orders, please contact us at customer@fairshop.ca. We will initiate a Canada Post trace on your behalf. Resolution timelines are set by Canada Post and are outside our control.
- Damaged mail: If your item arrives visibly damaged, you must notify us within 5 calendar days of delivery with photographic evidence of both the packaging and the item. We will work with Canada Post to file a damage claim. Fairshop's liability in the event of confirmed carrier damage is limited to the original purchase price paid.
- Tracking & Insurance: Not all Canada Post services include tracking or insurance. The service used for your order depends on the item and postage selected — some items are sent via untracked lettermail. Standard Canada Post liability coverage applies where applicable. We do not routinely purchase additional insurance unless requested; contact us before ordering if you require tracked shipping or additional coverage for a high-value item.
Returns & Refunds
Due to the collectible and mail-order nature of our products, all sales are final unless the item is demonstrably not as described or arrives in a condition materially different from what was listed.
- Eligible for return: Items that arrive significantly different from their listed condition (e.g., a Near Mint card received in Heavily Played condition), items that are incorrect (wrong card sent), or items confirmed lost or destroyed by Canada Post.
- Not eligible for return: Change of mind, buyer's remorse, duplicate purchases, or minor cosmetic variations that fall within normal photographic representation.
- Return window: Return requests must be submitted within 7 calendar days of the confirmed delivery date. Requests made after this window will not be accepted.
- How to request: Email customer@fairshop.ca with your order number, a description of the issue, and clear photographs of the item and its packaging.
- Return shipping: If a return is approved, we will advise on the return method. Return postage costs are covered by Fairshop only where the error was ours; they are the Buyer's responsibility in all other eligible cases.
- Refund method: Approved refunds will be issued via the same payment method used for the original purchase. Refund processing times depend on PayPal or your bank's timelines, which are outside our control.
Cancellations
Order cancellations are handled as follows depending on the payment method and order status:
- Interac e-Transfer — Pending payment: You may request cancellation of a pending Interac order through My Orders before payment is submitted. Only one Interac order may be pending at a time; cancelling a pending order frees you to place a new one.
- Interac e-Transfer — Payment received: Once your Interac payment has been confirmed and the order is being packed or mailed, cancellation is no longer possible.
- PayPal: PayPal orders are processed immediately. Once a PayPal payment is completed, cancellation is at our discretion and only possible if the item has not yet been submitted to Canada Post.
- After dispatch: No cancellations are possible once an item has been accepted by Canada Post. You may submit a return request after delivery if the item qualifies under Section 10.
User Conduct
By using the Site you agree not to:
- Provide false, misleading, or fraudulent personal information including your name, email address, or mailing address.
- Attempt to place orders with no intention of paying (e.g., placing multiple Interac orders and abandoning them).
- Initiate unjustified chargebacks or payment disputes against Fairshop.
- Attempt to circumvent account bans by registering with a new email address.
- Use automated tools, bots, or scripts to access or interact with the Site.
- Engage in any conduct that is abusive, threatening, or harassing toward Fairshop or its personnel.
- Attempt to reverse engineer, copy, or otherwise exploit any part of the Site's code or content.
Violation of this section may result in immediate and permanent account termination, cancellation of any pending orders, and — where applicable — referral to the appropriate authorities.
Limitation of Liability
To the fullest extent permitted by applicable law, Fairshop's total liability to you for any claim arising out of or relating to these Terms or your use of the Site shall not exceed the total amount paid by you for the specific order giving rise to the claim.
Fairshop is not liable for:
- Delays, losses, or damage caused by Canada Post or any other third-party carrier or service provider.
- Any indirect, incidental, special, consequential, or punitive damages of any kind.
- Loss of profit, loss of data, or loss of goodwill.
- Failure to deliver caused by an incorrect or incomplete address supplied by the Buyer.
- Any event outside our reasonable control, including natural disasters, postal strikes, pandemics, or government actions.
Nothing in these Terms limits or excludes liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation, to the extent such limitation or exclusion is prohibited by applicable law.
Privacy
By using the Site and placing an order, you consent to the collection and use of personal information as described below. We collect only what is necessary to fulfill your order and communicate with you.
- What we collect: Your email address, mailing address, IP address, and browser user-agent string at the time of registration; order details including items purchased and payment method used.
- Why we collect it: To verify your identity, process and fulfill your order, ship your item via Canada Post, and communicate order status updates with you.
- Who we share it with: Your mailing address is shared with Canada Post solely for the purpose of delivery. We do not sell, rent, or otherwise share your personal information with third parties for marketing purposes.
- Retention: We retain your information for as long as necessary to fulfill orders and meet our legal obligations under Québec and Canadian law, including the Act respecting the protection of personal information in the private sector (Québec Law 25).
- Your rights: You have the right to request access to, correction of, or deletion of your personal information by contacting customer@fairshop.ca.
Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the Province of Québec and the federal laws of Canada applicable therein, without regard to its conflict-of-law provisions.
Any dispute arising out of or in connection with these Terms, including any question regarding their existence, validity, or termination, shall be subject to the exclusive jurisdiction of the courts of the Province of Québec, sitting in the district of Montréal.
If you are a consumer resident in another province, you may also have rights under the consumer protection legislation of your home province, which may apply in addition to these Terms.
Changes to Terms
We reserve the right to update or modify these Terms and Conditions at any time. When we do, we will revise the "Last updated" date at the top of this page.
It is your responsibility to review these Terms periodically. Your continued use of the Site or placement of an order after any changes constitutes your acceptance of the revised Terms. We will not provide individual notice of changes to registered users; it is your responsibility to check this page.
